Whether between communities and companies, government entities, or among fellow citizens, land disputes often lead to prolonged conflicts and harm many parties involved.

Land disputes can also become enduring wounds that never seem to heal because even with court rulings, execution might not happen smoothly or be accepted by all parties.

There are many causes of land disputes, but generally, they can be categorized into two: internal and external factors.

Internal factors originate from within the community itself, such as unclear land ownership status, ignorance about land boundaries, disagreements over inheritance division, or administrative errors.

External factors stem from outside the community, such as corporate expansion, infrastructure development, land acquisition by the government, or third-party interventions.

One example of a land dispute caused by internal factors is the case in Negara Batin Village, Jabung District, East Lampung Regency. There, a land dispute erupted between residents and the cattle fattening company PT Austasia Stockfeed.

Residents claim that the land controlled by the company has been theirs for generations, while the company asserts ownership based on land ownership certificates issued by the government. This dispute has been ongoing since 2000 without resolution.

An example of a land dispute caused by external factors is the case in Cibitung Village, Cikarang Barat District, Bekasi Regency. There, a land dispute arose between residents and the Indonesian Railway Company (PT KAI).

Residents claim that the land used by PT KAI to build railroad tracks belongs to them, while PT KAI argues that the land belongs to the state and was handed over by the government. This dispute has been ongoing since 2014 and continues to this day.

Factors Influencing Land Disputes

In addition to the causes of land disputes, several factors influence their occurrence, such as social, economic, political, legal, and cultural factors. These factors are interconnected and complicate the resolution of land disputes.

Social factors pertain to human relationships, including beliefs, values, norms, attitudes, behaviors, and emotions.

Social factors can trigger land disputes due to differences in perspectives, interests, or aspirations among the involved parties. Social factors can also exacerbate land disputes due to prejudice, stereotypes, discrimination, or violence perpetrated by one party against another.

Economic factors relate to the production, distribution, and consumption of goods and services, including prices, demand, supply, capital, labor, and markets.

Economic factors can instigate land disputes due to competition, exploitation, or speculation by one party regarding land owned or desired by another party. Economic factors can also worsen land disputes due to inequality, poverty, or dependency experienced by one party as a result of the land dispute.

Political factors concern power, policies, and national interests, including government, parties, groups, or individuals.

Political factors can trigger land disputes due to intervention, manipulation, or corruption by one party regarding land that serves as a strategic resource or conflict. Political factors can also exacerbate land disputes due to injustice, lack of transparency, or bias displayed by one party in handling land disputes.

Legal factors involve rules, processes, and law enforcement, including laws, regulations, decisions, institutions, or authorities.

Legal factors can instigate land disputes due to ambiguity, inconsistency, or mismatch between customary, national, or international laws governing the land. Legal factors can also worsen land disputes due to non-compliance, disobedience, or powerlessness demonstrated by one party in following the law.

Cultural factors relate to lifestyles, worldviews, and community identities, including religion, customs, arts, language, or history.

Cultural factors can trigger land disputes due to differences, conflicts, or contradictions between the values, norms, or symbols inherent in the land. Cultural factors can also exacerbate land disputes due to neglect, insult, or destruction perpetrated by one party against the culture associated with the land.

Solutions for Land Disputes

Finding solutions to land disputes is not easy as it involves many parties, factors, and interacting aspects.

However, there are several principles that can guide the search for solutions to land disputes:

Solutions must be based on facts, data, and valid, objective, and accurate evidence, not on opinions, assumptions, or subjective, biased, or untrue speculations.

Solutions must respect the rights, obligations, and interests of all parties involved, without favoritism, discrimination, or exploitation of any party.

Solutions must prioritize dialogue, communication, and cooperation among all parties involved, without resorting to violence, intimidation, or threats against any party.

Solutions must reflect justice, equality, and well-being for all parties involved, without causing imbalance, poverty, or dependence on any party.

Solutions must consider the social, economic, political, legal, and cultural impacts on the environment and future generations, without damaging ecosystems, depleting resources, or threatening the sustainability of life.

One successful example of a solution applied to resolve a land dispute is the case in Sumber Jaya Village, Way Tenong District, West Lampung Regency. There, a land dispute occurred between residents and the Bukit Barisan Selatan National Park (TNBBS).

Residents claimed that the land controlled by TNBBS belonged to them for generations, while TNBBS claimed that the land was state-owned and designated as a conservation area.

The dispute had been ongoing since 1980 and had escalated into bloody conflicts. However, in 2000, residents and TNBBS agreed to resolve the land dispute through a mediation process facilitated by the Institute for Policy Research and Advocacy (ELSAM).

As a result, residents and TNBBS agreed to change the status of the land from a conservation area to a multiple-use area, where residents could cultivate the land as long as they did not damage the ecosystem. Additionally, residents and TNBBS agreed to form a forest farmer group, allowing residents to utilize forest products on the land without harming the ecosystem.

This agreement successfully resolved the land dispute and transformed the conflict into cooperation.

Land disputes are complex and multidimensional issues involving many parties, factors, and interacting aspects. Therefore, resolving land disputes requires a comprehensive, participatory, and sustainable approach involving all parties, considering all factors, and addressing all aspects.

Only in this way can we seek a permanent solution to lingering wounds and create justice, equality, and well-being for all parties involved.

That’s all for now Kisanak.

jlk – Hello everyone, land disputes are one of the frequent issues in Indonesia.
